General Terms and Conditions (GTC)

- Scope of Application
1.1 These General Terms and Conditions (“GTC”) apply to the services offered by Aesthe Clinic in accordance with the contract concluded between Aesthe Clinic and the customer.
1.2 All services are fully subject to these conditions unless modified or supplemented by written agreements. Upon conclusion of the contract, the GTC are acknowledged by the customer and are thus legally effective.
- Services
2.1 Aesthe Clinic commits to advising and caring for the customer within the framework of the agreed medical treatments according to the principles of medical services.
2.2 The medical treatments can only be utilized in person by the customer.
2.3 The agreed medical service is understood as a treatment contract in accordance with § 630a of the German Civil Code (BGB). Aesthe Clinic commits to carrying out the treatment carefully and professionally according to the current state of medical science.
- Treatment Modalities
3.1 The duration of a treatment session at Aesthe Clinic is between 30 minutes and 1.5 hours unless otherwise agreed.
3.2 The treatments take place in the practice rooms of Aesthe Clinic at Felix-Dahn-Str. 5, 70597 Stuttgart. Patients may only enter the treatment rooms individually, without accompanying persons.
3.3 Before the treatment begins, a medical questionnaire must be completed, which must be answered to the best of one’s knowledge and belief. This information is necessary for the safe execution and optimization of the treatment. Health issues, existing complaints, or injuries must not be concealed.
3.4 Both parties recognize agreements and arrangements for booking treatment sessions as binding, provided they are confirmed by both sides. This applies to all means of communication used, such as phone, email, or social media (e.g., WhatsApp).
- Cancellation
4.1 Appointments must be canceled at least 24 hours in advance. If the cancellation occurs later or not at all, Aesthe Clinic reserves the right to charge a cancellation fee of 70 euros.
- Prevention and Cancellation
5.1 In case of prevention, the patient must notify the cancellation of the appointment as soon as possible, but no later than 24 hours before the scheduled appointment. If the cancellation occurs later or not at all, Aesthe Clinic reserves the right to charge a cancellation fee of 70 euros.
5.2 Aesthe Clinic is entitled to withdraw from the contract or cancel a treatment session for good cause, especially if the treatment cannot be carried out due to staff illness or if treatment devices are not functioning. In such cases, already paid treatment sessions will be refunded at the customer’s request, or a new appointment will be scheduled. Patients do not have claims for damages in these cases.
- Liability
6.1 All questions regarding the current/past health status and life circumstances must be answered truthfully and completely. Any changes must be reported immediately.
6.2 The customer is responsible for insuring themselves against accidents and injuries that may occur during treatments in the practice. This also applies to the direct journey to and from the practice.
6.3 Aesthe Clinic is not liable for the loss of clothing, valuables, or money brought along.
6.4 The customer is not permitted to advertise any product or service to the employees, doctors, or other persons in the practice.
6.5 Customers are expected to treat all other customers with respect, avoiding discrimination based on race, gender, or religion.
- Data Protection
7.1 The personal data of the customer will be stored by Aesthe Clinic and used solely for the fulfillment of the aforementioned service.
7.2 The stored data will be deleted at the request of the customer, but no later than 24 months after the last booked treatment session. Furthermore, the provisions of the Federal Data Protection Act apply. Details can also be found in the privacy policy.
- Confidentiality
8.1 The patient commits to maintaining confidentiality about any business and trade secrets of Aesthe Clinic, even beyond the termination of treatments.
8.2 Aesthe Clinic commits to maintaining confidentiality regarding all information about the patient that becomes known in connection with the fulfillment of medical treatments, even beyond the termination of treatments.
- Final Provisions
9.1 Both parties commit to mutual loyalty and will not make any negative statements about the person or the products or services of the other or impair the reputation and prestige of the other.
9.2 Changes, additions, and side agreements require written form to be effective unless otherwise provided in these GTC.
9.3 The requirement for written form also applies to any waiver of this form requirement.
9.4 Should any of the preceding provisions be invalid or unenforceable, the validity of the remaining provisions shall not be affected. Instead of the invalid or unenforceable provision, a mutually agreed suitable, legally valid substitute provision that closely resembles the economic success will be made.
9.5 The place of fulfillment is Stuttgart. The law of the Federal Republic of Germany applies to this contract.
